Spright Privacy Policy

At Java Beach, Inc. dba Spright (“Spright”) we respect Your privacy and have established this Privacy Policy to describe our policies and practices with respect to the information that we collect from users (“Users”, “You” or “Your”) of our Services and Sites.  Please review this Privacy Policy before You use our Sites or any of the services or features offered on or through our Sites. By using our Sites and its Services and features, You agree to be bound by this Privacy Policy. If You do not agree to this Privacy Policy, please do not use our Sites or Services and features.

Remember that Your use of Spright’s Services is at all times subject to the Terms of Use, which incorporates this Privacy Policy.  Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Use.  

This Privacy Policy covers our treatment of personally identifiable information that we gather when you are accessing or using our Services, but not to the practices of companies we don’t own or control, or people that we don’t manage.  We gather various types of personal information from our users and we use this personal information internally in connection with our Services as explained in more detail below.

Spright may collect certain personal information from You when You register to use our Sites or its Services. Such information depends upon whether you are registering and accessing certain Services or Applications through Facebook or directly through one of Spright’s Applications.  For instance, if you are accessing the Services through Facebook or through an Application, Spright will have access to your name, email address, profile picture, and location. Additionally, through an Application onboarding process, Spright may request your baby’s photo, date of birth, gender, and first name. 

We may also collect certain non-personally identifiable information from Users of our Sites, such as their Internet protocol address, the type of browser and operating system they use, the domain name of Your Internet service provider, and the web pages, content and advertisements You may have visited, viewed or clicked on. We use various technologies to collect that information, including the following:

  • Cookies: We may utilize “cookies” to maintain a record of Your visits and to improve the content and services on our Sites. Cookies are text files placed in Your computer’s browser to store Your preferences. Cookies do not contain personal information, but if You choose to furnish us with personal information, this information may be linked to the data stored in the cookie.  If we have advertising partners, our advertising partners may also transmit cookies to your browser or device, when you click on ads that appear on the Services. Also, if you click on a link to a third party website or service, a third party may also transmit cookies to you.  Again, this Privacy Policy does not cover the use of cookies by any third parties, and we aren’t responsible for their privacy policies and practices.]  [You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of some of our features.]
  • Web beacons: Pages of our Sites may contain electronic images known as web beacons (also referred to as single-pixel gifs) that permit us to count Users who have visited those pages and for other related websites statistics (for example, recording the popularity of certain Sites content and verifying system and server integrity). Web beacons allow ad networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers.  Web beacons also enable ad networks to serve targeted advertisements to you when you visit other websites.   Web beacons are not used to access Your personal information on our Sites and are only used to compile aggregated statistics concerning use of our Sites. You may be able to opt-out of web beacon tracking conducted by third parties through our Services by adjusting the Do Not Track settings on your browser; please note that we don’t control whether or how these third parties comply with Do Not Track requests.
  • IP Addresses. Our computers may also collect Your IP address, which is a numerical address that is used to identify a computer connected to the Internet. We may use Your IP address to help diagnose problems with our server, to administer our Sites, to deliver web pages to You upon request, to tailor our Sites to the interests of our Users, and to measure traffic within our Sites.

We may use Your personal information to:

  • communicate with You, such as to respond to Your inquiries, send You newsletters, notify You if You are winner of a contest or sweepstakes, or notify You of any changes to any legal terms applicable to our Sites or Services or any changes to this Privacy Policy;
  • improve our Sites and the Content and Services offered on our Sites;
  • protect our Sites, Services, systems, information, employees, business partners, service providers, Users, customers or others; and
  • for any other purposes for which the information is collected and maintained
  • Optimize or improve our products, services and operations;
  • Detect, investigate, prevent, and respond to activities that may violate our policies or be illegal.

We may use Your non-personally identifiable information to analyze the usage of our Sites, improve the design and content of our Sites, deliver relevant marketing messages and advertisements, personalize Your Internet experience, and offer You products and services. In some cases, we may use Your IP address to identify You in order to enforce any legal terms that govern our Sites or to protect our Sites, services, systems, information, employees, business partners, service providers, Users, customers or others from injury or harm.

We may share Your personal information with third parties including in the following instances:

  • who assist us in providing our Sites and Services (such as data storage providers) and processing communications on and through our Sites;
  • for their direct marketing purposes;
  • names of winners of our contests and sweepstakes as may be required by law on our Sites and in winner’s lists;
  • law enforcement officials, to the extent we believe necessary to comply with laws, regulations, court or administrative orders, or other governmental authority or to prevent harm to Yourself or others;
  • certain User profile information or User Submissions may be displayed to other users to facilitate user interaction within the Services or address Your request for our Services.
  • businesses or third party websites we’re affiliated with may sell or provide products or services to you through or in connection with the Sites or Services (either alone or jointly with us.
  • where You have specifically authorized us to do so; and
  • upon a merger, acquisition, divestiture or transfer or sale of some or all of our assets or upon any other corporate reorganization, and in connection with the evaluation of and entry into the foregoing transactions.

We may also share non-personally identifiable information to third parties on an aggregate basis for purposes of analyzing usages and trends, improving or enhancing our Sites, improving existing products and services, and developing new ones.

Currently, we do not participate in any "Do Not Track" frameworks that would allow Spright to respond to signals or other mechanisms from You regarding the collection of your information. We may engage third parties, such as marketing or analytics partners, who may collect information about Your online activities over time and across different websites when You use our Sites.

The Services allow users to access Facebook to interact with friends and to share on Facebook through Wall and friends’ News Feeds. If You are already logged into the Services and Facebook, when You click on “Connect with Facebook,” You will be prompted to merge Your profiles. If You are already logged into the Services but not logged into Facebook, when You click on “Connect with Facebook,” You will be prompted to enter Your credentials or to “Sign Up” for Facebook. By proceeding, You are allowing the Services to access Your information and You are agreeing to the Facebook Terms of Use in Your use of the Services. Conversely, if You are not currently registered as a user of the Services, and You click on “Sign in” using Facebook, You will first be asked to enter Your Facebook credentials and then be given the option to register for the Services. In this case, we may receive information from Facebook to make it easier for You to create a Spright Account on the Site and show our relevant content from Your Facebook. Once You register on the Site and connect with Facebook, You will be able to automatically post recent activity back to Facebook. Any information that We collect from Your Facebook account may depend on the privacy settings You have with Facebook, so please consult Facebook’s privacy and data practices. You have the option to disable Facebook Connect at any time by logging into Your Spright Account through the Site and disconnecting Facebook through the Settings page. Further, You can edit privacy settings or disconnect your Services activity stream by visiting the Facebook Applications Settings page.

Spright is not intended for and does not knowingly collect information from children under the age of 13. If You believe that Your child is using our Sites or Services or that we have collected information from Your child, please contact us immediately so that we can remove that information from our database.

We employ reasonable security measures to protect the security and confidentiality of Your personal identifiable information that we collect and maintain. However, we cannot guarantee the security of Your personal information or that any communication or transmission of such information over the Internet will be entirely secure.

If You establish an account, You must prevent unauthorized access to your account and personal information by selecting and protecting your password appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.

Our Sites may contain links to websites or products and services offered by third parties. We do not endorse and are not responsible for the information collection practices of those third party websites. Your use of those third party websites is at Your sole and entire risk. We encourage You to review those third party websites and their privacy policies and the terms of use before using them or providing them any of Your personal information.

Certain portions of the Site may be co-branded with a business partner (“partner”) and subject to a different privacy policy that is either the partner's privacy policy or a privacy policy developed jointly by Spright and our partner (collectively the "Co-branded Policy"). The partner's collection, use and dissemination practices regarding any data or personal information provided by, or obtained from Users of these Co-branded portions of the Sites will be governed by the Co-branded Policy. Please read the Co-branded Policy for each Co-branded site before providing any personal information.

We may change our ownership or corporate organization, be sold or merge with another company. We may also sell assets associated with the Sites. We will have the right to transfer some or all of the information in our possession, including Personal Information concerning Users, in connection with a change of ownership, change of corporate organization, merger or sale of assets or equity. Under such circumstances we would endeavor to require the new company, acquiring party or merged company to follow the practices described in this Privacy Policy, as it may be amended from time to time. Nevertheless, we cannot promise that a new company, acquiring company or the merged company will have the same privacy practices or treat Your information the same as described in this Privacy Policy.

California Civil Code Section 1798.83 permits customers who are California residents to request certain information regarding its disclosure of their personal information to third parties for their direct marketing purposes. We reserve the right to amend or revise this Privacy Policy, in whole or in part, at any time in our sole discretion. Any such amendments will take effect on the earlier of when they are posted on our Sites or the date You are notified by email communication (at the email address provided in Your account). Your use of our Sites or its products and Services after such amendments have been posted shall constitute Your agreement to and acceptance of said amendments.
